Welcome to MageCDN, a subscription-based image hosting service. By using MageCDN (“we,” “us,” or “our”), you agree to the following Terms of Use. Please read these terms carefully before using our services.

1. Services and Subscriptions

MageCDN offers a cloud-based image hosting solution with monthly and yearly subscription plans. By subscribing to MageCDN, you agree to be billed automatically by our payment processor, Paddle.com, either on a monthly or yearly basis, depending on your selected plan. Additionally, any overage charges based on your usage will be billed at the end of the month.

1.1. Free Trial

We offer a free trial period during which you can use MageCDN without charge. At the end of the free trial, you will be automatically charged based on your selected plan unless you cancel before the trial ends.

1.2. Payment Processor

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

1.3. Cancellation and Data Deletion

If you choose to cancel your subscription:

• Your images will stop being served after two weeks from the end of the billing period or free trial.
• Your images will be permanently deleted after four weeks if no payment is received or your subscription remains canceled.

2. Refund Policy

Refunds are subject to our refund policy, as follows:

• Monthly Plans: Refund requests for monthly plans will only be considered within the first seven days of the billing cycle. Beyond that, no refunds will be issued.
• Yearly Plans: Refund requests for yearly plans will only be considered within the first two weeks of the billing cycle. After this period, no refunds will be issued.

We reserve the right to deny refund requests that do not meet these criteria. If your account is terminated due to a violation of the Acceptable Use Policy, we will provide a prorated refund based on the remaining time in your subscription.

3. Acceptable Use Policy

You agree not to use MageCDN to host or distribute any content that violates our Acceptable Use Policy. The following types of content are strictly prohibited:

• Nudity or sexually explicit material
• Provocative content meant to offend or shock
• Hate speech or content promoting discrimination or violence
• Gore or excessively violent imagery
• Spam or unsolicited promotional material
• Content condoning illegal activities or promoting harm to others

Any violation of this Acceptable Use Policy may result in the immediate suspension or termination of your account, and your images may be removed without notice.

4. Fair Use Policy

MageCDN is committed to ensuring fair use of its services. We reserve the right to monitor and limit excessive or abusive usage at our sole discretion. If we determine that your usage of MageCDN is disproportionately affecting the performance or security of our service or other users, we may:

• Impose usage limits
• Suspend or terminate your account

In the event of account suspension or termination due to abuse, a prorated refund will be issued based on the remaining subscription period.

5. Termination and Account Suspension

MageCDN reserves the right to terminate or suspend your account for any violation of these Terms of Use, including:

• Violation of the Acceptable Use Policy
• Failure to pay for services or overage charges
• Abusive or unfair usage of resources

In case of past-due payments or subscription cancellations, images will cease being served after two weeks and will be permanently deleted after four weeks unless the account is reactivated by making the required payments.

6. Modifications to the Service

MageCDN reserves the right to modify or discontinue the service at any time. We will make reasonable efforts to notify users of any significant changes, including changes in pricing or service features. Continued use of the service after such modifications constitutes acceptance of the revised terms.

7. Disclaimer of Warranties and Limitation of Liability

MageCDN is provided on an “as is” and “as available” basis. We make no warranties, either express or implied, regarding the service, including its availability, performance, or fitness for a particular purpose.

MageCDN will not be liable for any indirect, incidental, or consequential damages arising from your use of our service, including but not limited to data loss, business interruption, or loss of profits, even if advised of the possibility of such damages.
